The rules for using the OpenGa^3in gateway

Note. These terms have not yet been reviewed by counsel. They state the operating rules honestly and are binding on use of the service, but before a material commercial commitment either side may ask for a negotiated agreement instead.

01Who may use the service

OpenGa^3in is operated by Ga^3in Ventures LLC and offered by invitation to portfolio companies and selected partners. It is a business to business service. You must be at least 18 years old and acting for an organization that has been approved for access. It is not offered to consumers and it is not directed to children.

Each organization has an owner who is responsible for the keys created under it and for the conduct of everyone who uses them.

02Your content, and who owns what

You keep everything you send and everything you get back. We claim no ownership of your prompts, your outputs, or anything you build with them, and we do not store them (see data handling). We claim no licence to use your content to train or improve anything.

You are responsible for having the rights to what you submit, and for how you use what comes back. Model output can be wrong, biased, or unsuitable for a given purpose: it is provided without warranty and must not be treated as professional, legal, medical or financial advice.

03Acceptable use

Traffic through this gateway reaches third party model providers, whose own usage policies apply in addition to ours and are passed through to you. You must not use the service to:

We may suspend an organization immediately where use appears to breach this policy or threatens our own standing with a provider. Where practical we tell you first; where it is not, we tell you promptly after.

04Disclosure when you build on this

If your product presents model output to your own users, say so where it matters. Do not claim capabilities your system does not have, do not describe automated output as human, and do not overstate accuracy. Claims about artificial intelligence attract regulatory attention, and the obligation for your product is yours.

05Keys, budgets and limits

Keys are issued to your organization and shown once. Keep them secret: activity under your key is treated as yours. Tell us immediately if a key is exposed and revoke it in the portal, which takes effect at once.

Each organization carries a spend budget and rate limits, shown in the portal. Requests are refused once a budget is exhausted. Limits exist to keep one organization from starving another and may be adjusted, with notice where the change reduces what you have.

06Fees

Pricing is set per organization in your onboarding, whether sponsored, discounted, or at list. Prepaid credits are consumed by metered usage. Where an organization is invoiced, invoices are due on the stated terms. Credits carry no cash value and are not refundable except where required by law or where we have made a billing error.

07Availability

The service is provided as is, without an uptime commitment at this stage. We monitor the gateway continuously and alert on failure, but we do not promise uninterrupted service and are not liable for losses arising from downtime, provider outages, model changes, or model output. To the fullest extent permitted by law, our aggregate liability is limited to the fees you paid us in the three months before the claim.

08Communications

We send operational email only: onboarding, budget and outage alerts, billing, and material changes to these terms or to data handling. We do not add you to a marketing list, and if that ever changes it will be opt in with a working unsubscribe link in every message.

09Ending it

You may stop at any time: revoke your keys and tell us to close the organization. We may end access for breach of these terms, non payment, or if we discontinue the service, with reasonable notice except where a breach requires immediate action. On closure we delete organization metadata per the retention schedule in the data handling policy.

10Changes, and the law that applies

Material changes are announced to organization owners by email before they take effect. These terms are governed by the laws of the State of New York, and the courts of New York County have exclusive jurisdiction, without prejudice to mandatory consumer or local law protections that may apply to you.
